Department of Environment reviewing application by Delway Enterprises Ltd.
The Department of the Environment is considering an application to open a commercial dump on the Morrissey Road which is near the northern boundary of the Eel Ground First Nation. People from the First Nation have posted signs in protest of the proposed dump which appears to have been prepared for operation.
Facebook posts about the topic say the concern is the runoff from a dump. An image shows the elevation and the likely direction of runoff from the dump.
A spokesperson for the department has confirmed the following:
1. The Department has received an application form Delway Enterprises Ltd for an approval to operate a construction and demolition debris disposal site on a property located just off the Chapel Island Road. The application is being reviewed and the department has 90 days to make a decision
2. The application package stated that there was an information session scheduled on July 12 with neighbours of the proposed dump but it was cancelled due to Covid concerns. Regulations say an information session must be held for people who live within 500 meters of the site.
3. Regarding other dump sites that could be used, the Department restricts the number of construction and demolition dump sites in each district based on population levels. There is already such a site on the Beaverbrook Road and based on population levels it does not seem to warrant another site, however, the Department can evaluate the need for an additional site based on other criteria (more info: https://www2.gnb.ca/content/gnb/en/services/services_renderer.6195.Construction_and_Demolition_Debris_Disposal_Site_Approvals.html)
4. In the application package Delway indicated 6 test pits were completed based on where the disposal cells would be located, and the company will be installing monitoring wells to determine the depth of the groundwater table. It is still early stages and if the Department is not satisfied with the level of information provided by the applicant the Department can request further sampling.
