Brothers appear for trial, one admits axe assault

Witness is a no show and warrant issued

Brothers Terrance Edward Arbeau and John Matthew Arbeau were due to have a trial today on an assault on Mr. Lindsay Arbeau. Lindsay failed to show up and the Crown asked to have the trial adjourned until December 13th, and asked that Lindsay be arrested on a warrant. There is a possibility if he is arrested that he be held in custody until the trial takes place, because it is alleged he failed to show for the trial on another occasion as well.

John Arbeau’s lawyer objected to the adjournment but the judge agreed to move the trial to the 13th because the matter was not in jeopardy of going past the limit where it would be thrown out for delay.

After hearing that the trial would go ahead next week, John Arbeau’s lawyer said he would choose to plead guilty and wants to be sentenced right away because she felt Arbeau had already spent enough time in jail to satisfy a sentence on the matter. Terrance is not in custody, but John is in custody on the assault but also on other matters including assaulting an officer. John Arbeau has been in jail since June 14th.

John Arbeau changed his plea and admitted assaulting Lindsay Arbeau with an axe and committing mischief by damaging a vehicle. He will be back in court on December 13th for sentencing. His brother will appear on the same date. Lindsay Arbeau is still going to be arrested and brought before the court.

Terrance Arbeau has not pleaded guilty to the assault on Lindsay , so what he will do on December 13th is up in the air. Terrance also has two breach charges that don’t involve his brother or the victim, and he decided to plead guilty and will be sentenced on the 13th as well.
